End User License Agreement (EULA)

Last updated: August 18, 2026

1. Scope and contracting parties

This license agreement governs the use of the software RacePaintShop (“Software”) between you (“User”) and Markus Tausendfreund, Lachenweg 49, 4125 Riehen, Switzerland, email: support@tausendfreund.me (“Provider”). Sales and payment processing are handled by Polar Software, Inc., 3500 South DuPont Highway, Dover, DE 19901, USA, which acts as the seller in the legal sense (merchant of record) and takes care of invoicing as well as sales tax/VAT; its terms apply additionally to that extent (polar.sh/legal/terms).

2. Subject matter / license

The Provider grants you a simple, non-exclusive, non-transferable and perpetual right of use. The license is provided at a price of 50 CHF as a one-time payment (plus any taxes shown by the seller). It is not a subscription; future updates are included.

3. Trial period

The Software can be tested free of charge for 14 days. During the trial period, the full design toolset is available, but without export and without the AI feature. After that, a valid license is required.

4. Term

The right of use is perpetual and does not need to be renewed. It ends automatically if you breach material provisions of this agreement. You can stop using the Software at any time by uninstalling it.

5. Withdrawal / returns

Customers in the EU/EEA: In principle, there is a 14-day right of withdrawal. For digital content, it can expire if you expressly consent to immediate provision and acknowledge the loss of the right of withdrawal; this is obtained during the seller’s checkout process.
Customers in Switzerland: Under Swiss law, there is generally no statutory right of withdrawal/return for online purchases. Any voluntary refunds are subject to the seller’s terms.

6. AI feature and third-party providers

The optional AI design feature requires the User’s own API key for Google Gemini or OpenAI. By using it, you transfer input/images to the respective provider; its terms apply. The Provider gives no warranty for the availability, quality or freedom from third-party rights of AI-generated results. You are responsible for generated and used content (including the rights of third parties).

7. Rights to content / third-party templates

You may use the liveries you design within the scope of applicable rights. The underlying vehicle templates and trademarks (e.g. iRacing or Le Mans Ultimate) as well as services such as Trading Paints are subject to the rights and terms of the respective rights holders. Compliance with them is your responsibility.

8. No affiliation with third parties

RacePaintShop is an independent tool and is not affiliated with, endorsed or sponsored by iRacing.com Motorsport Simulations, Motorsport Games/Studio 397 (Le Mans Ultimate), Trading Paints, Google or OpenAI. Trademarks mentioned belong to their respective owners and are used only to describe compatibility.

9. Intellectual property

All rights to the Software (code, design, the “RacePaintShop” trademark) remain with the Provider. Reverse engineering, decompilation or circumventing the license/activation mechanisms are prohibited, unless mandatorily permitted by law.

10. Warranty and liability

The Software is provided “as is.” To the extent permitted by law, liability for slight negligence is excluded; this does not affect liability for intent, gross negligence or mandatory statutory liability. Mandatory consumer rights of the country of residence remain unaffected.

11. Privacy

The separate privacy policy applies.

12. Changes

The Provider may amend these terms with effect for the future, insofar as this is reasonable while safeguarding your legitimate interests (e.g. changes in the law, new features).

13. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is — to the extent permitted — Riehen or Basel-Stadt, Switzerland. Mandatory consumer protection provisions of the country of your habitual residence (e.g. in Germany/the EU) remain unaffected.

14. Severability clause

Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
